Scope of Services


Promo Panda ("we," "us," or "our") is a specialized visa support and public relations firm that works exclusively with O-1, EB-1A, EB-2, and P-3 visa applicants. 


We provide PR, evidence-building, and documentation services to support visa applications. We are not a law firm and do not provide legal advice, legal representation, or immigration services. 


Our services include media article placement, scholarly article facilitation, and evidence compilation through our Complete Pathway program.


No Attorney-Client Relationship


Use of Promo Panda's services does not create an attorney-client relationship. While we work closely with immigration attorneys and may facilitate introductions to qualified legal counsel, we are not attorneys and cannot provide legal advice.



Clients should consult with qualified immigration attorneys for legal guidance regarding their visa applications.


Success Rates and Representations


While we are proud to report that the overwhelming majority who maintain communication with us achieve eventual visa approval, this statistic:


  • Is based only on clients who have reported their outcomes to us
  • Includes clients who may have received RFEs or needed to refile applications
  • Reflects the combined efforts of clients, their attorneys, and our services
  • Does not guarantee similar outcomes for future clients

Each visa application is unique and subject to various factors beyond our control, including but not limited to USCIS officer discretion, policy changes, and the strength of individual applications.


Limitation of Liability


To the maximum extent permitted by law, Promo Panda shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from:


  • Use of our services
  • Reliance on information provided through our services
  • Decisions made based on our deliverables
  • The outcome of any visa application
  • Technical errors or limitations
  • Changes in immigration policy or USCIS interpretation

Indemnification


You agree to indemnify, defend, and hold harmless Promo Panda, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:


  • Any violation of these terms
  • Any misrepresentation in your application materials
  • Any claims arising from your use of our services
  • Any unauthorized use of our platform or services

Arbitration Agreement


Any dispute arising from or relating to these terms or our services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall:


  • Take place in our jurisdiction of registration
  • Be conducted by a single arbitrator
  • Be strictly confidential

You agree to waive any right to pursue claims on a class or consolidated basis.


Force Majeure


Promo Panda shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:


  • Acts of government or regulatory changes
  • Natural disasters or public health emergencies
  • Technology platform outages or cyber incidents
  • Changes in media outlet policies or availability

Data Retention and Destruction


We maintain the following data practices:


  • Client files are retained for 7 years after service completion
  • Personal data is encrypted during storage and transmission
  • Data destruction follows industry-standard secure deletion protocols
  • Clients may request data deletion subject to legal retention requirements

Jurisdiction and Venue


These terms shall be governed by the laws of our jurisdiction of registration. 


For any matters not subject to arbitration, you consent to the exclusive jurisdiction and venue of courts in our jurisdiction of registration for any litigation arising from these terms or your use of our services.


Privacy and Confidentiality


Having served over 4,500 clients since 2016, we take client privacy seriously. Information shared with Promo Panda is handled according to strict confidentiality protocols. However, please note:


  • Information provided to media outlets as part of our PR services will become public
  • We may share necessary information with partner attorneys and service providers who are bound by confidentiality obligations
  • We maintain client confidentiality regarding the use of our services unless explicitly authorized by the client to disclose such information
  • Aggregate data may be used to improve our services and success rates

Client Obligations


By using our services, clients agree to:


  • Provide accurate and truthful information about their qualifications and experience
  • Not misrepresent their skills, expertise, or work history
  • Review and approve all content before publication
  • Maintain professional communication with media contacts we facilitate
  • Promptly respond to requests for information or approval

Complete Pathway Service


For clients enrolled in our Complete Pathway service:


  • The 9-month timeline is an estimate and may vary based on individual circumstances
  • Delivery of specific evidence categories is subject to client qualification and market conditions
  • Service modifications may be necessary based on visa strategy changes

Refund Policy


While we strive to deliver all promised services:


  • Refunds are limited to specific deliverables we fail to secure within agreed timeframes
  • No refunds are provided for services already rendered
  • Refund requests must be submitted in writing with supporting documentation

Modification of Terms


We reserve the right to modify this disclaimer at any time. Continued use of our services following any changes constitutes acceptance of the modified terms.


Severability


If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect and enforceable.
