A common question I get asked is how to become an EB2 candidate. The easy way to do so is by being eligible for Employment Based Second Preference (EB2P) visa sponsorship. This article will go into more detail about this, as well as other options such as working in the field of medicine or education.
In fact, one can even qualify through family membership! If you are interested in exploring these routes, make sure you check out our articles here at Immigration Advice Hub. We have done all the hard work for you!
We also look at some potential stumbling blocks that may prevent people from applying using the second preference system, so be aware of those. In this article we will talk about what kind of qualifications make you qualified to apply under this category.
Embrace change and learn new things – both professionally and personally
This doesn’t mean staying in your current job forever, but rather seeking opportunities to expand upon your role or develop new skills. Employers want to know if you can add value to their company and they will give you chances to show off these abilities.
By demonstrating engagement with others, teamwork and communication skills, and flexibility, employers will keep you onboard and inspire loyalty. These are valuable assets when looking for employment.
Change is a constant thing in life, which makes it important to accept it. It could be changing jobs, locations or fields, or just learning something new every day.
An L-visa is a nonimmigrant, or temporary residence in the United States. The term 'non immigrant' means you do not have long term residency status in America. You must return home at the end of your stay here.
Most employers require their employees to hold a work visa (or employment authorization) before they can start working for the company. These visas are usually categorized as B2 for business travelers and O1 for immigrants seeking employment in the US.
The other most common visa type for professionals in the field like yourself is the F-visa. This is the OPT VISA and it allows skilled workers to live and work in the country for up to six months. You will need this visa if you are traveling for professional purposes.
An L-Visa is only given to individuals who cannot find work in the USA and will be returning home soon. Most people use the L-visa when visiting family in the states also. Many times, these visitors are graduates or retired college professors that want to enjoy the American culture while exploring different parts of the country.
The other major requirement for an EB2-B is that your business must be located in the United States. This means that even if you have permission to work here, you can’t apply if your company isn’t operating within our borders.
There are some exceptions to this rule. For example, if your headquarters are outside of the US but all of your offices are inside, or if most of your employees live outside of America then you would meet the geographic requirement.
However, even if none of these things are true it will still be difficult to get the necessary approval because there has to be clear proof that your business will remain here.
It is also important to know that even if you have an excellent credit score, you will not be able to work in the United States as a non-resident alien without having an F visa (Business Account) or E visa (Employment Authorization).
These visas are only given to those who are engaged in business activities in America, so it makes sense to do this first!
By opening a business account, you can start working on your US Visa while actively engaging in business activity here. This way, you don’t have to worry about getting the job done before your visa expires because you’ll get new ones every two years.
Even though there is no cost to apply for an F-1 visa, it does not mean that you do not have to pay to remain in the United States. You will be asked to prove your income while living here, which can include showing proof of employment or proof of savings.
If you are able to show both, then most likely you will be granted the permission needed to stay in America. If you do not have either one, you may need to find other ways to prove your money.
Some way to prove your savings might be having a second job, or owning a house or car that costs more than $500. Having multiple sources of income makes people believe they will be paid again at some point. Owning a home shows that you have lived here for a long time so many things assume that you will still be here.
Having savings proves that you know how to spend money well. Many employers require this when they hire you. They want to make sure that you could afford to live on your own and that you would not go bankrupt if something bad happened.
In most cases, you will need an additional letter of permission or endorsement from your current employer/school before you can leave the country with a B2 visas. If this is not the case, then it is recommended that you find another job and make sure it’s very clear what time you will be leaving.
It is best to get these letters as early as possible because once you enter America using a tourist visa, there are limited opportunities to re-enter Canada unless you have an entry stamp in your passport. This could also pose trouble if you decide to return home later!
If you do run into problems when trying to enter or exit USA, there are some things you can do to help mitigate the situation. There are even ways to apply for American resident status which would make it easier to stay in the US longer.
If you are ready to apply for your EB2 category, then you can do so here at the Consulate General of Switzerland in Chicago!
The process is very similar to what we discussed earlier with the B2 F-series visa, except that there is no requirement to live in the United States while applying. You can either be a resident or nonresident of the country where you will reside while waiting for your residency status to be approved.
In addition to this, it is important to know that people who have an employment based green card already must leave the country before they can begin the application process for the second one.
This is because employers run background checks during job interviews, and if they find out that you do not yet have legal residence in the US, you cannot start working for them until you get official permission to stay.
It is not easy to pay for your VISA, but it is definitely doable! There are many ways to approach paying for your VISA directly through the embassy in Bangkok or via an online VISA seller service.
The most expensive way to purchase a visa is at the Thai Embassy in person. This can be very difficult as there is no way to pre-pay for a visa before you arrive in Thailand. You will have to either bring enough money to buy the visa when you arrive in Thailand or make sure you know where to spend your money after you enter the country.
Alternatively, some people use an Online VISA Seller Service to purchase their visa. These services usually offer lower prices than going into a restaurant or consulate sponsored event. They also keep changes of payment methods confidential so you don’t have to worry about leaving a bad reputation behind you if something goes wrong.
Now that you are eligible, next is to get your passport stamped for employment in Canada as a working student! This can be done at any Canadian embassy or consulate. To make things easy, most places have an online application process now where you can apply and pay through the website.
Some of these websites even allow you to schedule an appointment so you do not have to come during business hours only. Some require you to speak with someone before processing, but this is usually just to verify your identity and confirm your residency status.
We recommend doing it this way if possible as it makes applying much easier than having to take time out of your day to go into a office first. Many people find it more convenient this way too because they do not need to physically travel anywhere either.
Be sure to check the regulations for each country’s requirement as well. For example, some countries may require proof of health insurance while others may ask for proof of tuition fees paid directly to the institution.
